Acceptable Use Policy
This Acceptable Use Policy (“AUP”) outlines the actions that are prohibited when using the services provided by Responsive IP. By ordering or using Responsive IP’s Services, whether as a Customer or Service Recipient, you agree to abide by the terms stated in this AUP. It is important for each Customer to review and comply with this AUP and all relevant laws. However, please note that this AUP is not intended to serve as legal advice or an exhaustive list of all laws and regulations that apply to your use of Responsive IP’s Services. There may be additional state and foreign laws that are applicable.
By using Responsive IP’s Services, you agree not to engage in or encourage any illegal, abusive, or disruptive activities that interfere with the business or operations of Responsive IP or any third party. This includes, but is not limited to, the following:
- Security Risks: Using the Services in a manner that poses a security or service risk, or attempting to bypass or disable any security mechanism on the Services. Reverse-engineering the Services for inappropriate purposes. Using the Services in a way that may cause liability, damages, or harm to Responsive IP or any third party.
- Service Disruption: Initiating or facilitating any denial of service attack on the Services, or engaging in any conduct that negatively affects the availability, reliability, or stability of the Services.
- Malicious Software: Transmitting any material containing viruses, trojan horses, worms, or malicious or harmful programs.
- Unsolicited Marketing: Engaging in unsolicited advertising or marketing activities that violate relevant marketing laws and regulations, such as the Telephone Consumer Protection Act, the CAN-SPAM Act of 2003, or comparable state laws. Using the Services to make unsolicited or harassing calls or messages, including unwanted phone calls, SMS or text messages, voicemail, or faxes, to individuals who have not given their consent or have revoked their consent to be contacted by you.
- HIPAA Compliance: Using the Services to handle Protected Health Information as defined by the Health Insurance Portability and Accountability Act of 1996 (HIPAA), unless you have signed a Business Associate Agreement with Responsive IP or your use of the Services falls within an exception for requiring a Business Associate Agreement.
- Fraudulent Activities: Using the Services for fraudulent activities or in connection with fraudulent behavior. Violating or facilitating the violation of any local, state, federal, or foreign laws or regulations, including those governing the transmission of data or software.
- Intellectual Property Infringement: Transmitting any material that infringes upon the intellectual property rights or other rights of third parties.
- Malicious Content: Transmitting any defamatory, libelous, discriminatory, or otherwise malicious or harmful material to any individual or entity.
- False Identity: Creating a false identity, forged email address or header, or phone number, or attempting to mislead others regarding the sender’s identity or the origin of a message or phone call, including non-compliance with the Truth in Caller Identification Act and related regulations.
- Unauthorized Use: Using the Services, or any component thereof, in any unauthorized manner not permitted by Responsive IP.
Please note that the list of prohibited uses provided above is intended to be illustrative and not exhaustive. All determinations regarding violations of this Acceptable Use Policy will be made at the sole discretion of Responsive IP, in a reasonable manner. Responsive IP reserves the right to modify or change the terms of this AUP at any time, with immediate effect upon posting on the Responsive IP website. Your continued use of Responsive IP’s Services after any changes to the AUP are posted will constitute your acceptance of the modified or additional terms.
